Welcome to the information website for the Kirkpatrick, et al. v. Wells Fargo Bank & HSBC Bank Settlement

A Settlement Agreement has been reached in a class action lawsuit (the “Action”) against Wells Fargo Home Mortgage (“Wells Fargo”) and HSBC Bank USA (“HSBC”) (“Defendants”). A total Settlement Fund of $1,300,000.00 (“Settlement Fund”) will be established to provide compensation to Class Members. Payments will be distributed to Class Members who do not exclude themselves from the settlement (as further described below) if the District Court approves the settlement or after appeals, if any, are resolved in favor of the settlement. Please be patient.

You may be a member of the class if you meet the below criteria:

All (1) borrowers on Wells Fargo home mortgage accounts; (2) with a West Virginia mailing or property address as set forth in Wells Fargo’s system of record; (3) that participated in COVID forbearance; and (4) received a letter between March and December of 2020 discussing what would happen with missed COVID forbearance payments at the end of the loan period.

Your Legal Rights and Options in This Settlement

DO NOTHING AND RECEIVE A SETTLEMENT CHECK

If you do nothing, you will be included in the Settlement, and you will receive an automatic payment from the Settlement Fund.

EXCLUDE YOURSELF FROM THE SETTLEMENT BY DECEMBER 22, 2025.

If you want to exclude yourself from, or “opt out” of, the Settlement, you must submit a Request to Opt Out to the Claims Administrator, postmarked on or before December 22, 2025. If you do so, you will not receive any money from the Settlement Fund and you will not release your claims in the lawsuit.

If the Settlement is granted final approval by the Court and you did not timely “opt out” of the Settlement, then you will release the claims described within.

OBJECT TO THE SETTLEMENT BY DECEMBER 22, 2025.

If you remain in the Settlement and want to object because you believe the Settlement is unfair or inadequate, you may file a written objection to the Settlement with the Court, on or before December 22, 2025.

GO TO A HEARING

If you file an objection and also want to speak at the Final Approval Hearing, you must file a written Notice of Intention to Appear, which must be filed and postmarked on or before February 20, 2026.
